New Advertising Rules Go Into Effect

A modified version of amendments to the Disciplinary Rules, related to advertising and solicitation, became effective on February 1, 2007. The new rules are available on the New York State Bar Association website or at the Office of Court Administration’s websiteSpecial attention should be given to the definitions of the terms: “advertisement," “computer-accessed communication” and “solicitation.”

“Solicitations” are defined as “any advertisement initiated by or on behalf of a lawyer... that is directed to, or targeted at, a specific recipient or group of recipients, or their family members or legal representatives...“ The final version of the new rules will require filing of a copy of the solicitation and the transcript of the audio portion of any radio or television solicitation, which is directed to, or targeted at, a specific recipient or group of recipients in this State. Web sites are excluded unless designed for, and directed to, or targeted at “a prospective client affected by an identifiable actual event or occurrence.” Not all “advertisements” are “solicitations”! However, when deciding what to file, the rule should be read carefully, and given the broadest possible interpretation.

Unsolicited communications to persons affected by an incident, involving claims for personal injury or wrongful death, cannot be made before the 30th day after the date of the incident, unless a filing must be made within the 30 days to preserve the victim’s rights, in which case a 15 day rule is applied. Such solicitations must also include a disclosure of how the lawyer obtained the identity of the recipient and learned of the recipient’s potential legal need.

The new prohibitions on the content of “advertisements” should also be carefully examined. Included in the “shall not” section of the rule are the uses of nicknames, monikers, motto or trade names that imply an ability to obtain results in a matter. Endorsements and testimonials from current clients are prohibited, as are paid testimonials without disclosing the fact of compensation. Advertisements may not contain the portrayals of judges, and the use of actors or fictionalized scenes without disclosure of same. Also prohibited are the use of techniques to obtain attention that demonstrate a clear and intentional lack of relevance to the selection of counsel, including the portrayal of lawyers exhibiting characteristics clearly unrelated to legal competence.

Federal Court Practice CLE Postponed

The Federal Court Practice CLE program scheduled for Wednesday, February 21st, has been postponed due to a scheduling conflict with another program on a similar topic.

If you are currently registered or pre-paid for this program, your registration and payment are still recorded and on hold for the future date.  The program will be rescheduled for a date in late March or April.  Please check the website for any updates or call Bethany at the Bar Office (471-2667) for information regarding the new date or transfers of payment toward a different CLE program.

Repeal of 22 NYCRR part 1010
Civil Appeals Settlement Program

Effective February 1, 2007, the Appellate Division, Fourth Department, is repealing Part 1010 of the rules of the Court (22 NYCRR part 1010), and abolishing its Civil Appeals Settlement Program (CASP).  CASP covered civil appeals, except appeals arising pursuant to CPLR article 70, CPLR article 78, the Election Law, the Family Court Act and section 168-n (3) of the Correction Law.

Beginning February 1, 2007, an appellant will no longer be required to file a pre-calendar statement at the time that the notice of appeal is filed, and County Clerks are no longer under any obligation to transmit notices of appeal and pre-calendar statements to the Appellate Division, Fourth Department.

American Mock Trial Association
Seeks Attorney Evaluators
February 16, 17 and 18

This February there is an exciting opportunity here in Syracuse to spend four enjoyable hours and earn four free CLE credits.

The College of Arts and Sciences and the iLearn program at Syracuse University are happy to be hosting the regional mock trial competition, which is part of the American Mock Trial Association’s collegiate mock trial program.  On February 16, 17 and 18 Syracuse University will be hosting 26 teams from the northeast United States to compete in a trial competition.  Each trial is approximately three hours long and afterwards the students always look forward to comments from the attorneys who have volunteered to evaluate the competition.  The students are scored by the evaluating attorneys and at the end of the weekend regional champions are selected to move on to compete in a national championship competition at the end of March.  All of the participants in these competitions are undergraduate students and they have spent many months preparing for the competition.

The education of these young students is important to make sure the next generation of citizens have an appreciation of the judicial system and how it works.  This education is enhanced by learning opportunities like this and these competitions cannot work without the assistance of local attorneys.  This year the Syracuse College of Law will be providing four CLE credits to volunteer evaluators.  A minimum of 26 evaluators for each of the four rounds is needed.  There is one round on Friday evening, two rounds Saturday during the day and one round Sunday morning.
