On all initial filings of Orders to Show (OSC) for temporary
relief in matrimonial actions which request a temporary order of protection
(TOP), the action will be assigned off the matrimonial assignment wheel in the
court clerk=s office, and possible
return dates for that assigned justice will be written on the green cover sheet
by the court clerk=s office. The
papers will then be forwarded to Hon. Bryan R. Hedges, Acting Supreme Court
Justice. He will review the papers, sign the OSC and TOP, if appropriate, and
return the papers to his part clerk. The clerk will take care of forwarding any
TOPS to the registry and then return the papers to the civil back office staff
for date entry and forwarding to the assigned justice=s
part clerk.
On subsequent OSCs in matrimonial actions where a TOP is
requested, the papers will be referred to the previously assigned matrimonial
part justice. If he is not available to sign the papers, the papers will go to
Hon. Bryan R. Hedges, Acting Supreme Court Justice for his review and signature,
if appropriate. If Justice Hedges is not available, the papers would then go to
another matrimonial part justice, if available. If no other matrimonial justice
is available, the papers would go to the Calendar Judge for that term.
NOTE:
The party requesting the TOP must
provide a completed information sheet along with their papers. We must
have full addresses, including home and work addresses for all
parties.
For Orders to Show Cause where no TOP is requested, the
papers will be assigned to a matrimonial justice and forwarded to his chambers
for signature. If he is not available (e.g., it is for Justice Nicholson and it
is Justice Nicholson=s Oswego term),
the papers will be sent to Justice Hedges for review and signature. Justice
Hedges will be provided with a list of return dates for the assigned justice on
the cover sheet from the clerk=s
office.
