Effective
May 1, 2006, the Appellate Division, Fourth Department
is instituting a Civil Appeals Settlement Program (CASP).
This program will cover appeals in most civil matters,
with certain specified exceptions. The purpose of CASP
is to identify appeals that may be amenable to
settlement or to a limitation of the issues presented on
appeal. (Part 1010 of 22 NYCRR).
The rule requires a party who is filing a notice of
appeal in a case that is subject to the CASP to file a
precalendar statement at the time that the notice of
appeal is filed. The appellant must attach to the pre
calendar statement a copy of the order or judgment from
which the appeal is taken as well as a copy of the
court;s decision, if any (22NYCRR 1010.3).
The rule further requires the clerk of the court from
which the appeal is taken to promptly transmit the
precalendar statement to the Appellate Division,
together with a copy of the notice of appeal (22NYCRR
1010.4). This rule applies to notices of appeal filed on
or after May 1, 2006.
