In
response to a letter addressed to OCBA President, Ellen
S. Weinstein, dated September 6, 2006 from Frederick B.
Warder, III, Assistant Counsel to the State of New York
Commission on Judicial Nomination, we would like to
bring to your attention the Commission’s interest in
receiving recommendations and applications of persons
who may be qualified to serve as an Associate Judge of
the New York Court of Appeals. A vacancy will exist on
January 1, 2007 because of Associate Judge Albert M.
Rosenblatt’s mandatory retirement for age. The deadline
for receipt of completed questionnaires is September 27,

The New York State
Commission on Judicial Nomination announced that the
Commission is seeking recommendations and applications
of persons who may be qualified to serve as an Associate
Judge of the New York Court of Appeals. A vacancy
will exist on January 1, 2007, because of Associate
Judge Albert M. Rosenblatt's mandatory retirement for
age. Recommendations may be made to, and
applications procured from Counsel to the Commission,
Stuart A. Summit, at the Commission office, 666 Fifth
Avenue, 28th Floor, New York, New York 10103-0084 (Tel.:

ssummit@phillipsnizer.com. The deadline for
the receipt of completed questionnaires is September 27,
2006, but all interested persons are urged to telephone,
write or email Mr. Summit as soon as possible.
As previously announced,
those who filed questionnaires for the vacancy created
by the end of Associate Judge George Bundy Smith's team
need not file another questionnaire.
The Commission on Judicial
Nomination was created by Article 6, § 2 of the New York
State Constitution. the Commission nominates three
to seven persons for a vacancy in the office of
Associate Judge, from whom the Governor must select his
appointment for the vacancy. The Governor's
appointment is subject to confirmation by the New York
Senate. Of the twelve members of the Commission,
four are chosen by the Governor, four by the Chief Judge
of the State of New York, and one each by the Speaker of
the Assembly, Temporary President of the Senate,
Minority Leader of the Senate and Minority Leader of the
Assembly.
In the past, the Commission
has nominated to the Governor a wide variety of lawyers,
including private practitioners, law professors,
government officials and incumbent Federal and State
judges. While prospective candidates must file a
questionnaire with the Commission, recommendations may
be made by anyone who believes that a prospective
candidate could be an excellent judge of the highest
court of New York State. |
