Waiver of Process:Consent to Probate

As of April 1, 2011, the Onondaga County Surrogate's Court will no longer be able to accept for filing "Waiver of Process: Consent to Probate" unless submitted on the Court's form (or on a form in strict conformity with such form).  A copy of the Court's "Waiver of Process: Consent to Probate" is attached.  Consent forms only consenting to the probate and not the issuance of Letters Testamentary pursuant to the relief requested in the Petition will not be accepted and, if submitted by mail, will be returned unfiled.  The Petition will be left pending until a proper consent form is submitted or citation issued.
