TOPICS COVERED:

  • Overview of the Medicare Secondary Payer Statute and “Rules” provided by CMS/Medicare for the compliance of same using Medicare Set Asides and Negotiating and Reimbursing Lien/Conditional Payments for all lines of insurance.
  • Structured Medicare Set Asides will be briefly discussed and questions addressed by a licensed structured settlement broker.

Presenters:

Ryen DeStefano, Esq. – Ms. DeStefano has worked extensively in the area of CMS/Medicare conditional payment liens dipsute process. Prior to her work with MSA Advocates, Ms. DeStefano’s area of practice included gender and age discrimination. She earned her J.D. and B.A. from Syracuse University. She is admitted to the bar of New York State and is an active member of the New York State Bar Association. Ms. DeStefano is an MSA Consultant at MSA Advocates, Inc., in Syracuse and resides in the Town of Onondaga.

Kathleen B. Oot – Licensed Workers’ Compensation Representative and Structured Settlement Broker. President and CEO of MSA Advocates, Inc. Ms. Oot’s career spans 30 years adjusting Workers’ Compensation Claims for claimants and carriers. Ms. Oot also is experienced and knowledgeable in the Section 111 reporting requirements under the Medicare, Medicaid SCHIP Extension Act of 2007 and the Medicare Secondary Payer Statute. As a structured settlement broker, Ms. Oot is experienced in the structuring of Medicare set asides for insurance settlements and Medicare compliance as outlined by Medicare’s “Rules.” In 2001, the Government began enforcing Medicare set asides for settlements. In 2002, Ms. Oot founded MSA Advocates, Inc. Since 2002, MSA Advocates, Inc. has developed into a national vendor providing carriers and attorneys with Medicare set aside servics for the settlement of claims. Ms. Oot has participated and preessnted at many workshops and training courses on the topics of Medicare Set Asides, Section 111 reporting requirements and structured settlements. Some of these courses included continuing education credits for claim representatives and attorneys.

In addition to Ms. Oot’s experience in workers’ compensation claims/Law, Ms. Oot’s experiences include handling and structuring (as a structure broker) general liability and labor law claims. As a claim representative and claim supervisor, she was responsible for preparing, reserving, investigating and settling (with structured settlements) labor law and general liability claims and law suits.
